This invoice, if and as necessary under the law, is an estimate of repair and service costs as detailed herein.

Installation & Life of Tire Maintenance Charge

Installation includes all labor and parts necessary to install or replace a tire, such as a tire pressure monitoring system rebuild kit or rubber valve stem. Life of Tire Maintenance includes Rotation, Rebalance, Tire Flat Repair, Tire Inspection and Air Check for the life of the tire installed on your vehicle. The Installation & Life of Tire Maintenance charge may vary based off market and installation complexity.

Winter Tire Installation Charge

Installation & Life of Tire Maintenance does not include winter tire removal and/or reinstallation service. Winter tire removal and/or reinstallation is an additional charge and may vary based off market and removal or reinstall complexity.

State Mandated Tire Fee and Waste Tire Disposal Fee

If applicable, this invoice includes a state-mandated tire fee imposed by state law at the rate established thereunder. This state-mandated tire fee is distinct from America's Tire’s disposal fee for America's Tire’s proper disposal of tires removed from your vehicle.

No Seller Warranty

All tires, wheel, or parts (“Products”) and services offered by America's Tire are provided “as is” and without any warranty from America's Tire whatsoever, whether express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose, to the extent permitted by law. Notwithstanding the foregoing, this disclaimer does not, in any way, limit or otherwise affect the terms of any applicable warranties from the manufacturer of the Products.

Products are not from original equipment manufacturer

The Products purchased, installed, and/or used are supplied by a source other than the manufacturer of your motor vehicle (also known as non-OEM or aftermarket parts). Any warranties applicable to these Products are provided by the manufacturer or distributor of these Products rather than the manufacturer of your vehicle or America's Tire.

No Storage or Bailment Created; Vehicle Storage Fee

America's Tire does not store vehicles and does not permit customers to leave vehicles with America's Tire for a period of time in excess of that time necessary to complete service on your vehicle and a reasonable period thereafter. If circumstances outside America's Tire's control warrant that your vehicle remain in America's Tire's possession for a longer period of time, you may be charged a storage fee at the maximum statutory rate in America's Tire's sole discretion.

Return or Inspection of Replaced Products

You are entitled to inspect or return of all Products replaced, except those which are too heavy or large, those required to be sent back to the manufacturer or distributor because of warranty work or an exchange agreement, or any part required by any federal or state statute or rule or regulation to be disposed of by the facility.

Louisiana

THE PRODUCTS BEING SOLD ARE IN AN "AS IS" CONDITION, WITHOUT ANY WARRANTIES OF ANY KIND WHATSOEVER. PURCHASER EXPRESSLY WAIVES THE WARRANTY OF FITNESS AND THE WARRANTY AGAINST REDHIBITORY VICES AND DEFECTS, WHETHER APPARENT OR LATENT, IMPOSED BY LOUISIANA CIVIL CODE ARTICLES 2520 THROUGH 2548, INCLUSIVE, AND ANY OTHER APPLICABLE STATE OR FEDERAL LAW AND THE JURISPRUDENCE THEREUNDER.

PURCHASER ALSO WAIVES ANY RIGHTS PURCHASER MAY HAVE IN REDHIBITION TO A RETURN OF THE PURCHASE PRICE OR TO A REDUCTION OF THE PURCHASE PRICE PAID PURSUANT TO LOUISIANA CIVIL CODE ARTICLES 2520 TO 2548, INCLUSIVE, IN CONNECTION WITH THE PRODUCTS HEREBY CONVEYED TO PURCHASER BY SELLER. PURCHASER EXPRESSLY ACKNOWLEDGES ALL SUCH WAIVERS AND PURCHASER'S EXERCISE OF PURCHASER'S RIGHT TO WAIVE WARRANTY PURSUANT TO LOUISIANA CIVIL CODE ARTICLE 2520 AND 2548, INCLUSIVE.

PURCHASER ACKNOWLEDGES AND DECLARES THAT NEITHER THE SELLER NOR ANY PARTY, WHOMSOEVER, ACTING OR PURPORTING TO ACT IN ANY CAPACITY WHATSOEVER ON BEHALF OF THE SELLER HAS MADE ANY DIRECT, INDIRECT, EXPLICIT OR IMPLICIT STATEMENT, REPRESENTATION OR DECLARATION, WHETHER BY WRITTEN OR ORAL STATEMENT OR OTHERWISE, AND UPON WHICH THE PURCHASER HAS RELIED, CONCERNING THE EXISTENCE OR NON-EXISTENCE OF ANY QUALITY, CHARACTERISTIC OR CONDITION OF THE PRODUCTS SOLD.

THE AFOREMENTIONED WARRANTY DISCLAIMERS DO NOT, IN ANY WAY, LIMIT OR OTHERWISE AFFECT THE TERMS OF ANY APPLICABLE WARRANTIES FROM THE MANUFACTURER OF THE TIRES, WHEELS AND PARTS.

Minnesota

THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE GOODS IS WITH THE BUYER.
